Terms of Service

Welcome to echo. These Terms of Service ("Terms") govern your access to and use of the echo mobile application, website, and related services (collectively, the "Service"). By accessing or using echo, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

1. About echo

echo is a language learning application designed to help users improve speaking, listening, reading, pronunciation, and fluency through interactive games, real-life phrases, AI-powered voice lessons, native human voices, and social learning features.

echo is intended for personal, non-commercial educational use only.

2. Eligibility

To use echo, you must:

Be at least 18 years old (or the minimum age required by your local law, whichever is higher)
Be legally capable of entering into a binding agreement
Provide accurate and complete information when creating an account

By using echo, you represent and warrant that you meet these requirements. Community features — including posts, comments, reactions, and audio study rooms — are restricted to eligible users only.

3. Account Registration

To access certain features, you may be required to create an account.

You agree to:

Provide accurate, current, and complete information
Keep your login credentials secure
Be responsible for all activities that occur under your account

You are responsible for maintaining the confidentiality of your account and for any loss or damage resulting from unauthorized access.

4. Acceptable Use

You agree not to:

Use echo for any illegal, harmful, or abusive purpose
Harass, threaten, impersonate, or harm other users
Upload, post, or share content that is offensive, hateful, sexually explicit, or violates the rights of others
Use audio study rooms to conduct activities outside of language learning, including harassment, spam, or solicitation
Attempt to reverse engineer, modify, or interfere with the Service
Circumvent any security, access controls, or usage limits
Use automated systems (bots, scrapers) without permission
Misuse the camera, microphone, or screen recording features for any purpose other than the intended in-app functionality

We reserve the right to suspend or terminate accounts that violate these rules.

5. User Content

echo allows you to submit or share content, including profile information, posts, comments, reactions, voice in study rooms, and other learning activity ("User Content").

You retain ownership of your User Content. However, by submitting content, you grant echo a non-exclusive, worldwide, royalty-free license to use, store, display, and process your content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content and any consequences resulting from it. You agree not to post content that is defamatory, obscene, discriminatory, or otherwise objectionable.

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful to other users or to the community.

6. Voice, Audio, and AI Lesson Features

echo includes the following audio and AI-powered features:

Speech recognition for pronunciation practice and evaluation during exercises and games
echo AI Teacher: an AI-powered voice agent that interacts with you in real time during lessons to teach language and evaluate your responses
On-device offline text-to-speech (Piper TTS) for generating lesson audio
Background music and sound effects for the learning environment

These features are provided for educational purposes only. echo does not guarantee perfect accuracy in speech recognition, pronunciation feedback, AI responses, or translations. The AI teacher is not a substitute for professional language instruction.

7. Camera and Screen Recording

Certain interactive pronunciation game features within echo require access to your device's camera and screen recording capabilities.

Camera and screen recording access will only be requested when you enter a feature that requires it.
This data is used solely for the intended in-app game functionality.
You may revoke these permissions at any time via your device settings, though doing so will disable the relevant game features.
You agree not to misuse these features to capture, record, or share content involving other users without their consent.

8. Community Features — Posts, Comments, and Reactions

echo includes a social community feed where users can publish posts, comment on other users' posts, and react to content.

You agree to:

Post only content that is respectful, appropriate, and relevant to language learning or the echo community
Not post spam, promotional content, misinformation, or content that violates any applicable laws
Not harass, threaten, or demean other users in comments or reactions

We reserve the right to remove content, restrict accounts, or take other action in response to community violations. We do not endorse or take responsibility for any User Content posted by users.

9. Audio Study Rooms

echo includes a collaborative audio room feature that allows users to join live voice-based sessions with other learners (similar to live audio community platforms).

By participating in audio study rooms, you agree to:

Use the feature solely for language learning and community discussion consistent with these Terms
Treat all room participants with respect
Not record, capture, or distribute audio from any room session without the explicit consent of all participants
Not use rooms to conduct activities unrelated to the echo community, including solicitation, harassment, or broadcasting objectionable content

We reserve the right to remove users from rooms, restrict room access, or terminate room sessions that violate these Terms.

10. echo+ Subscription

echo offers a paid premium subscription called echo+ that unlocks additional features, including access to all courses and unlimited AI teacher sessions.

10.1 Subscription Plans and Pricing

echo+ is offered as auto-renewable subscriptions:

Monthly Plan: USD $49.99 per month
Annual Plan: USD $499.99 per year

Pricing may vary by region based on local taxes and App Store pricing tiers. The exact price will be displayed to you before confirming your purchase.

10.2 Billing and Automatic Renewal

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
You can manage or cancel your subscription at any time in your Apple ID account settings.
Deleting the app does not cancel your subscription.

10.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings.

If you cancel, you will retain access to echo+ features until the end of your current billing period. After that date, your subscription will not renew and you will not be charged again.

10.4 Refunds

All subscription purchases are processed through the Apple App Store (or Google Play Store, where applicable).

Refund requests are handled by the respective app store provider and are subject to their refund policies. echo does not process or issue refunds directly and does not control the outcome of refund requests.

10.5 Price Changes

We may change subscription pricing from time to time. If required by applicable law or platform rules, we will provide notice before new pricing takes effect. Continued use of echo+ after the effective date constitutes acceptance of the updated pricing.

11. Intellectual Property

All content and materials provided by echo, including text, audio, visuals, software, logos, branding, AI-generated lesson content, and the echo AI teacher system, are owned by echo or its licensors and are protected by intellectual property laws.

You may not copy, distribute, modify, record, or create derivative works of any echo content without prior written permission.

12. Termination

We may suspend or terminate your access to echo at any time, with or without notice, if:

You violate these Terms
You misuse the Service, community features, audio rooms, or camera/microphone features
We discontinue the Service

You may terminate your account at any time through the App's settings.

Upon termination, your right to use the Service will immediately cease. Termination does not entitle you to any refund of subscription fees.

13. Disclaimer of Warranties

echo is provided on an "as is" and "as available" basis.

We make no warranties, express or implied, including but not limited to:

Fitness for a particular purpose
Accuracy or reliability of AI teacher responses, pronunciation feedback, or learning outcomes
Uninterrupted access to the Service, audio rooms, or any community feature
Accuracy of speech recognition or translation output

Your use of echo is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, echo shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of progress, or loss of opportunities arising from your use of the Service, including use of community features, audio rooms, AI lessons, or camera-based game features.

In no event shall echo's total liability exceed the amount you paid to use the Service in the three (3) months preceding the claim, if any.

15. Indemnification

You agree to indemnify and hold harmless echo, its affiliates, and team members from any claims, damages, losses, or expenses arising from:

Your use of the Service, including community posts, audio rooms, and camera features
Your violation of these Terms
Your violation of any rights of another user or third party
Content you post, broadcast, or share within the App

16. Third-Party Services

echo integrates with third-party services including but not limited to:

RevenueCat for subscription management
Apple App Store / Google Play Store for payment processing
AI providers for powering the echo AI teacher voice agent
LiveKit for real-time audio transmission in study rooms

Your use of these integrations is also subject to the respective third-party terms of service and privacy policies. echo is not responsible for the practices of third-party providers.

17. Changes to These Terms

We may update these Terms from time to time.

When we do, we will update the "Last updated" date and notify you within the App if the changes are material.

Your continued use of echo after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles.
